DMCA Policy for ShutterShare.Art

Introduction
ShutterShare.Art respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), ShutterShare.Art will respond promptly to claims of copyright infringement committed using the ShutterShare.Art service and website (the “Service”) if such claims are reported to ShutterShare.Art's Designated Copyright Agent identified in the sample notice below.
Reporting Claims of Copyright Infringement
If you believe that your work has been copied in a way that constitutes copyright infringement, please provide ShutterShare.Art's Designated Copyright Agent with the following information in writing (your “DMCA Notice”):
- Identification of the copyrighted work that you claim has been infringed. Please describe the work and, where possible, include a copy or the URL of an authorized version of your work.
- Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit ShutterShare.Art to locate the material. Please provide URLs of the allegedly infringing material to help us identify the content.
- Information reasonably sufficient to permit ShutterShare.Art to contact you, such as an address, telephone number, and, if available, an email address at which you may be contacted.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Your physical or electronic signature.

Counter-Notification Procedures
If you believe that your content was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with ShutterShare.Art (a “Counter-Notice”) by submitting written notification to our Designated Copyright Agent (contact information provided above). Pursuant to the DMCA, the Counter-Notice must include substantially the following:
- Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the content.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal court in [your jurisdiction], and that you will accept service of process from the person who provided the DMCA Notice or an agent of such person.
- Your physical or electronic signature.
If a Counter-Notice is received by the Designated Copyright Agent, ShutterShare.Art will send a copy of the Counter-Notice to the original complaining party, informing that person that ShutterShare.Art may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed content may be replaced, or access to it restored, within 10 to 14 business days or more after receipt of the Counter-Notice, at ShutterShare.Art’s sole discretion.
Repeat Infringer Policy
ShutterShare.Art takes copyright infringement seriously and has adopted a policy to terminate, in appropriate circumstances and at ShutterShare.Art's sole discretion, users who are deemed to be repeat infringers. ShutterShare.Art may also, at its sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
Modifications
ShutterShare.Art reserves the right to modify, suspend, or terminate this DMCA Policy at any time without prior notice. Changes to this DMCA Policy will be posted on this page, and your continued use of the Service after such changes have been posted will constitute your acceptance of such changes.
